This essay answers the question: Which are the themes often considered as “Philosophy of Law” that are of concern to legal scholars? My answer seeks to sort out how the “thematic content” has become into what today is known as “Philosophy of Law” to legal scholars (against “Philosophy of Law” to philosophers). To deal with this question I will consider Norberto Bobbio’s point of view.Resumen:En este texto trato de responder a la pregunta: ¿cuáles son los temas calificados generalmente como “de (...) filosofía del derecho” que nos interesan a los juristas? The Constitutional State, in its initial configuration as a liberal Constitutional State, recognised a series of basic individual rights as fundamental rights. Subsequently, in the second half of the 20 th century, social, economic and cultural rights were integrated into the Constitution, creating the social Constitutional State. However, although said group of rights are always mentioned as a compact group, or a package of rights, in fact the second recognition only took place, in the strictest sense, with respect of social (...) and economic rights, and, to a much lesser degree, in respect of cultural rights. Largely, the cultural rights are forgotten rights in the Constitutional State, but today our society is multicultural. This is a contradiction. The text provides the basis for a progressive recognition of cultural rights in the Constitutional State. Also, the text discusses the benefits for all if we consider these rights as rights of the person, that is, as rights of all persons and not only of minorities. (shrink)

Contemporary popular culture is riddled with references to Mexican drug cartels, narcos, and drug trafficking. In the United States, documentary filmmakers, journalists, academics, and politicians have taken note of the increasing threats to our security coming from a subculture that appears to feed on murder and brutality while being fed by a romanticism about power and capital. Carlos Alberto Sánchez uses Mexican narco-culture as a point of departure for thinking about the nature and limits of violence, culture, and personhood. (...) A Sense of Brutality argues that violent cultural modalities, of which narco-culture is but one, call into question our understanding of “violence” as a concept. The reality of narco-violence suggests that “violence” itself is insufficient to capture it, that we need to redeploy and reconceptualize “brutality” as a concept that better captures this reality. Brutality is more than violence, other to cruelty, and distinct from horror and terror—all concepts that are normally used interchangeably with brutality, but which, as the analysis suggests, ought not to be. In narco-culture, the normalization of brutality into everyday life is a condition upon which the absolute erasure or derealization of people is made possible. (shrink)

Wittgenstein defiende que los problemas filosóficos son ilegítimos. Sin embargo, no resulta del todo claro qué se entiende en general por problema filosófico, cuál es, pues, su naturaleza. El presente artículo intenta elucidar la observación de Wittgenstein que sostiene que la forma de un problema filosófico se puede presentar con la expresión “Yo no sé salir del atolladero” (IF § 123). En el artículo se elige, a manera de ejemplo, el escándalo kantiano, que demanda que demostremos con el uso de (...) la razón que la proposición “hay objetos físicos” es verdadera. Sin renunciar al ejemplo, se explora en qué sentido la expresión de Wittgenstein caracteriza en buena medida la naturaleza misma de la dificultad filosófica. En el ejercicio se atienden recomendaciones formales del Tractatus, terapias desplegadas en Sobre la Certeza y el recurso de distinguir entre sentido primario y sentido secundario de una expresión insinuado en las Investigaciones Filosóficas. This major publication is a history of the semantic tradition in philosophy from the early nineteenth century through its incarnation in the work of the Vienna Circle, the group of logical positivists that emerged in the years 1925-1935 in Vienna who were characterised by a strong commitment to empiricism, a high regard for science, and a conviction that modern logic is the primary tool of analytic philosophy. In the first part of the book, Alberto Coffa traces the roots of (...) logical positivism in a semantic tradition that arose in opposition to Kant's theory that a priori knowledge is based on pure intuition and the constitutive powers of the mind. In Part II, Coffa chronicles the development of this tradition by members and associates of the Vienna Circle. Much of Coffa's analysis draws on the unpublished notes and correspondence of many philosophers. The book, however, is not merely a history of the semantic tradition from Kant 'to the Vienna Station'. Coffa also critically reassesses the role of semantic notions in understanding the ground of a priori knowledge and its relation to empirical knowledge and questions the turn the tradition has taken since Vienna. Ethical debate surrounding human enhancement, especially by biotechnological means, has burgeoned since the turn of the century. Issues discussed include whether specific types of enhancement are permissible or even obligatory, whether they are likely to produce a net good for individuals and for society, and whether there is something intrinsically wrong in playing God with human nature. We characterize the main camps on the issue, identifying three main positions: permissive, restrictive and conservative positions. Human-centered explainable AI (HCXAI) advocates for the integration of social aspects into AI explanations. Central to the HCXAI discourse is the Social Transparency (ST) framework, which aims to make the socio-organizational context of AI systems accessible to their users. In this work, we suggest extending the ST framework to address the risks of social misattributions in Large Language Models (LLMs), particularly in sensitive areas like mental health. In fact LLMs, which are remarkably capable of simulating roles and personas, may lead (...) to mismatches between designers' intentions and users' perceptions of social attributes, risking to promote emotional manipulation and dangerous behaviors, cases of epistemic injustice, and unwarranted trust. To address these issues, we propose enhancing the ST framework with a fifth 'W-question' to clarify the specific social attributions assigned to LLMs by its designers and users. This addition aims to bridge the gap between LLM capabilities and user perceptions, promoting the ethically responsible development and use of LLM-based technology. (shrink)

A completeness theorem is established for logics with congruence endowed with general semantics (in the style of general frames). As a corollary, completeness is shown to be preserved by fibring logics with congruence provided that congruence is retained in the resulting logic. The class of logics with equivalence is shown to be closed under fibring and to be included in the class of logics with congruence. Thus, completeness is shown to be preserved by fibring logics with equivalence and general semantics. (...) Husserl, a la vez que se abrió paso entre las indagaciones ya existentes sobre la fundamentación de las matemáticas. Fue precisamente dentro de esta constelación de publicaciones donde se originó una de las polémicas filosóficas más interesantes de las postrimerías del siglo XIX: la recensión de Filosofía de la aritmética hecha por Frege en 1894. Lo que ofreceré en este texto son (...) algunas claves de interpretación que permitirán hacer una revisión juiciosa de aquellos aspectos filosóficos no vistos por Frege en su crítica. In Leibniz’s New Essays stands out, within many important topics, his doctrine of innate ideas, which supposes the division between sense knowledge and innate knowledge and implies the distinction between truths of reason and truths of fact. That doctrine is particularly relevant for Leibniz’s philosophy, but implicitly entails the epistemological difference between belief, on one hand, and certainty, on the other. In this paper I outline, according to my interpretation, how Leibniz explains that humans can have certainty about innate ideas. (...) This topic is important because if Leibniz demonstrates the possibility of having certainty of those ideas, then, it is feasible to believe in its existence. However, if his explanation is unsatisfactory his metaphysical doctrine would be seriously weakened and, at the same time, both skepticism and Locke’s empiricist doctrine would be reinforced. Gestützt auf die bisher unveröffentlichten Teile des Briefwechsels von Leibniz mit Denis Papin aus der Zeit von 1692 bis 1700 wird in diesem Aufsatz versucht, einige Aspekte der Leibnizschen Dynamik darzulegen. Insbesondere wird der apriorische Beweis der Erhaltung der actio f ormalis im Zusammenhang mit der Diskussion zwischen Leibniz und Papin über die Messung der Kraft bei der horizontalen Bewegung behandelt. Es war Leibniz* Absicht, durch den apriorischen Beweis die Dynamik zu begründen und die Cartesianischen Gesetze der Bewegung zu ersetzen. (...) Papin seinerseits beschränkte sich auf die physikalische Ebene der Gesetze der Mechanik. Im Laufe der Debatte entwickelte Leibniz als Antwort auf Papins Kritik wichtige Argumente über die metaphysische Begründung der Dynamik. Die Begriffe actio f ormalis, inertia naturalis, entelecheia und Geschwindigkeit als quantitas intensiva werden in diesem Zusammenhang von Leibniz gegen Papins Einwände verteidigt. (shrink)

In his recent book on the philosophy of mind, Tim Crane has maintained that intentional objects are to be conceived as schematic entities, having no particular intrinsic nature. I take this metaphysical thesis as fundamentally correct. Yet in this paper I want to cast some doubts on whether this thesis prevents intentionalia, especially nonexistent ones, from belonging to the general inventory of what there is, as Crane seems to think. If my doubts are grounded, Crane’s treatment of intentionalia may further (...) be freed from a certain tension that seems to affect it, namely the fact that he appeals to nonexistent intentionalia in order to individuate intentional states and at the same time he attempts at dispensing with them. Husserl places “around 1898” the introduction of the notion of ‘ phenomenon’ in his philosophy. If one of the tasks of the history of philosophy is to circumscribe the problems which originated the creation of a new concept in some doctrine, the purpose of this paper is to investigate what difficulties had roused the invention of the idea of ‘phenomenon” in the husserlian philosophy.

Husserlian phenomenology has been interpreted as a method of knowledge that can be applied to different domains and which would compete with other methods to give us a better understanding of the “real”, the “man” or “society”. Moreover, “phenomenological idealism” has been presented as an “ontological” or “metaphysical” thesis, in the pre-critical sense of the term. The goal of this study is to suggest that these two theses imply the tacit identification of the natural attitude and the phenomenological one, avoiding (...) the difference between the objects to which these attitudes relate. O presente artigo abordará a construção do conhecimento em Giambattista Vico embasando-se no discurso De Nostri Temporis Studiorum. Com a troca da “imaginação” pela “racionalidade”, colocou-se de lado a engenhosidade humana, anulando assim a verossimilhança que fora negada por não apresentar verdades factuais levando à atrofia do engenho. O intuito aqui é analisar o desenvolvimento imaginativo proposto por Vico, gerando uma nova crítica. Conclui-se sobre uma possível epistemologia das humanidades, na qual cada sujeito possa, com seus próprios instrumentos, desenvolver um (...) conhecimento menos “dogmático” e mais humano, partindo de um solo estável, qual seja, a história. COVID-19 Lockdown was particularly challenging for most mothers of people with intellectual disabilities, including those with Rett syndrome, leading to feelings of abandonment from healthcare services of their children. Within those days, telerehabilitation has represented a valid alternative to support physical activity and treatment, supporting parents in structuring their children’s daily routine at home. This article aims to describe the well-being level of two groups of mothers of girls and women with RTT who were involved in a home-based remotely supervised (...) motor rehabilitation program, respectively, before and during the COVID-19 Italian lockdown. Forty participants with classic RTT were recruited before the lockdown and randomly assigned to two groups that performed the intervention immediately before and during the lockdown, respectively. The intervention included an individualized daily physical activity program carried out for 12 weeks by participants’ parents and fortnightly supervised throughout Skype contacts to plan, monitor, and accommodate individual activities in the participant’s life at home. The short form Caregivers Well-Being Scale was collected for the mothers in each group 12 weeks before intervention, at intervention initiation, immediately after intervention termination, as well as at 12 weeks after intervention termination. Mothers of participants in the Group 1 showed a stable level of well-being across all four evaluations with a slight improvement during the lockdown, without significant change. Similarly, the well-being level of mothers in the Group 2 showed a statistically significant increase in their well-being between T2 and T3 and its reduction to the pre-intervention level between T3 and T4. The results suggest that the lockdown did not negatively affect the participants’ mothers’ well-being, leading to its improvement. Moreover, the proposed intervention could have supported the mothers in managing the new daily routine at home, positively affecting maternal well-being. (shrink)

Trees with indistinguishability relations provide a semantics for a temporal language “composed by” the Peircean tense operators and the Ockhamist modal operator. In this paper, a finite axiomatization with a non standard rule for this language interpreted over bundled trees with indistinguishability relations is given. This axiomatization is proved to be sound and strongly complete.

This article builds on Gadamer’s rehabilitation of the Augustinian concept of inner word. Unlike most interpretations, the thesis is that the Augustinian inner word does not show the potentialities, but rather the ineffectiveness of ontological hermeneutics. In the first section, it is argued that for the later Augustine, the verbum in corde is the consequence of a Word- and Truth- event. In the second section, the author suggests that Gadamer has properly understood the verbum in corde as a matter of (...) faith. In the third section, it is shown that Gadamer has found in the notion a paradigm for his philosophical and theological insights. Concerning the former, he has always been fascinated by the evenemential character of the ‘second’ Heidegger’s thought. Concerning the latter, Gadamer has explicitly accused Bultmann’s demythologization of being ‘human, all too human’, and he has implicitly praised Barth’s dialectical theology. (shrink)

The paper attempts at yielding a language‐independent argument in favour of fictional entities, that is, an argument providing genuinely ontological reasons in favour of such entities. According to this argument, ficta are indispensable insofar as they are involved in the identity conditions of semantically‐based entities we ordinarily accept, i.e. fictional works. It will also be evaluated to what extent this argument is close to other arguments recently provided to the same purpose.
